It is the responsibility of the service user's duty holder / responsible person to:
Have a legionella risk assessment, written scheme of control and schematic diagram in place which includes a programme of treatment, monitoring, and inspection (and may include legionella sampling) and make this available to us.
Provide sufficient information to allow us to design an appropriate treatment programme, including a legionella sampling plan if appropriate.
Make the systems available for the agreed work, with safe access, and adequate notice to ourselves to schedule and execute the agreed work.
Provide us with any information on known risks and safety requirements in the areas we will be working.
Ensure the control scheme tasks you are responsible for are completed and recorded.
Participate in the agreed review process.

We have LCA membership for the legionella control activities detailed above. Please note that MWS staff and your site personnel are responsible for the maintenance and upkeep of the legionella control records. These records are located in the log book(s) held on the site detailed above.
All service user records will be maintained for five years, and these are available to the service user upon request.
The procedure for any waste removal created by the works will be confirmed in the method statement issued prior to works taking place.
Please ensure that suitable drainage points are identified and available for the works.
Please ensure that safe access can be made to the work areas.
Please ensure that any plant and/or other sensitive equipment that has restrictions imposed on it by the manufacturer is disconnected as it should not come into contact with the disinfectant to be used.
Please ensure any dead legs, redundant pipework, equipment, and infrequently or unused outlets are made available to ensure an effective disinfection.
Please be aware that disinfection of your system will not guarantee the eradication of legionella bacteria as there may be other factors that could prevent the disinfection from being effective. To ensure maximum effectiveness system disinfection should be used in conjunction with the guidelines detailed in HSG 274 Parts 1, 2 & 3 and HTM 04-01 Parts A & B. Alternative control and treatment methods should be explored if persistent detection of legionella bacteria occurs.
Legionella risk assessment proposals – what you need to know
Please note the below and ensure the following prior to works commencing:
We will verbally and via email, notify the person(s) above of any urgent non-conformances found during the assessment.
A written scheme will not be produced as part of the assessment but the assessment can be used to assist in formulating one.
An executive summary will be included specific to the site being assessed.
The risk assessment will be issued electronically to the person(s) detailed above. Any queries or other matters regarding the final report will be dealt with via email communication.
Any unavoidable omissions, the effect they may have on the assessment of risk, whether the required information can be obtained by other means and what provision should be made to provide access on a subsequent occasion and any addition implications will be defined in the final report.
Any reported information (not directly observed by the assessor) will be identified in the assessment.
We confirm our assessor is competent to undertake the task.
A suitable, knowledgeable, site escort will be required during the assessment for guidance around the system.
Please advise us prior to our arrival on site who will be responsible for the assessor’s safety and if any safety or induction training is required.
We will require access to any previous risk assessments, written schemes and records that have been carried out. Review of these documents will be included in the assessment process. Reference to the location of these documents will be made should scrutiny of the assessment be necessary. Existing schematic diagrams (if available) will be checked for accuracy. If new schematic diagrams are required, then these will be produced as part of the assessment. The implications of not being able to access these items will limit the effectiveness of the risk assessment.
Any systems to be excluded will be detailed above.
If areas of repetition exist (i.e. identical units, guest rooms or flats) then an agreement on what proportion will be assessed/surveyed will be agreed by the MWS account manager and the person(s) detailed above.

There are several key responsibilities that the dutyholder has a legal duty to address. These are listed below:
Ensure there is a Legionella risk assessment record that includes all systems where water is stored/used in any premises controlled by the duty holder, and that it is reviewed regularly to ensure it is valid and reassessed when required.
Clearly define the scope of any required Legionella risk assessment.
Make reasonable enquiries of proof of competence of the Legionella risk assessor.
Ensure any schematic diagrams and asset registers are available to inform and help the risk assessor.
Ensure the findings of the legionella risk assessment including the required corrective actions and control measures are implemented, or if not implemented recorded as to why they were not.
Ensure a written scheme of control is produced and maintained and the output from the scheme of control is recorded and used in any subsequent review of risk.
Ensure regular reviews of the effectiveness of Legionella control activities are carried out to verify the written scheme of control remains adequate and if they are not to carry out a review of the legionella risk assessment.
Have change management procedures and or regular review procedures to determine if the existing risk assessment is still valid, suitable, and sufficient. If it is not, then a reassessment of the risk is required.

Clean and disinfection/disinfection/remedial work proposals – what you need to know

If indicated on the quote, please ensure that a competent person is available during the works for isolation of system valves.

Maintain the water system, and the water in it, in a clean condition and to facilitate inspection to determine if the system is clean or not.
Make the systems available for the agreed work, with safe access, and adequate notice to ourselves to schedule and execute the agreed work.
Provide us with any information on known risks and safety requirements in the areas we will be working, and advise of any known deadlegs, redundant pipework and the location of schematic diagrams.
Ensure any preparatory work you are responsible for is completed prior to commencing cleaning and disinfection work.
Ensure any necessary trade effluent discharge consent is in place for effluent generated from the cleaning and disinfection process.

Installation proposals – what you need to know
Please note the below and ensure the following prior to works commencing:
Please inform us of specific site requirements, which may include (but are not limited to); induction procedures, access permits and permits to work, accident and emergency reporting, security arrangements.
Please note that it is your responsibility to inform and seek permission from the relevant water supplier regarding any modifications that are being proposed to the water system and to ensure that these meet with any regulations that they may impose.
Details of management and operational safety of the installed plant and equipment will be supplied once the installation is complete.
It is your responsibility to ensure that any modifications made to the system are reflected in the legionella risk assessment, system drawing(s) and asset register(s).

Ensure the necessary trade effluent discharge consent is in place for any effluent generated from any equipment installed
Ensure any preparatory work you are responsible for is completed prior to commencing plant and equipment work
Ensure any equipment is installed, commissioned, operated and maintained correctly

Training proposals – what you need to know
The training offered covers general legionella awareness and duty holder & responsible person training. The course will be held at a pre-agreed, suitable location and will consist of a power point presentation, student participation and practical elements. If the training is being held at a customer chosen location then the venue will need to be suitable to deliver a classroom type training session, have appropriate audio visual equipment, a flip chart or whiteboard and a suitable wi-fi connection. Please speak with your account manager if you need further clarification or help with this.
The objective of the course is to provide practical and theoretical knowledge of the legislation and guidance.
All delegates will be assessed at the end of the course to ensure content has been followed. It is assumed that the delegates present will be able to follow instructions, take notes, work by themselves and in a group and work safely. The assessment will require the delegates to provide clear, unambiguous written records and this will be checked prior to issuing certification.
Certificates will be issued to all delegates successfully passing the assessment. Further training will be identified for those who require it.
